McClellan v. Long Beach Community Hospital

Date: March 17, 1995

RESULT: A jury found in favor of plaintiffs and awarded a gross verdict with a total present cash value of $5,844,186. The jury found the child's mother 7% negligent, the mother's doctors, who were not sued, 10% negligent, and the defendant 83% negligent.

STATE: California

SUMMARY: On March 12, 1993, at Long Beach Community Hospital in California, Linn McClellan was attempting to give birth vaginally following a previous cesarean section. She suffered a ruptured uterus during labor, resulting in a severe Birth Injury to the child.

In a suit against the hospital, it was alleged that for ten minutes the nursing staff failed to appreciate signs and symptoms of the ruptured uterus, resulting in a ten-minute delay in delivery.

Defendant contended that the initial symptoms claimed by plaintiff were not specific, and when the rupture appeared, a cesarean section was performed within 15 minutes of the call for a crash cesarean section.
