Fact: In September 2002, Joseph Gaffney, a construction worker, was working at a site in Manhattan where he was joining steel beams. The scaffolding underneath of him collapsed, and he fell approximately 30 feet. He injured his head, back and neck during the fall.
He and his wife, Vicki Gaffney, sued the construction company's contractor, Turner Construction Co., and the site's owner, BFP 300 Madison II. They claimed that the site was not properly protected. They were granted pretrial summary judgment on liability. The trial addressed damages only.
