FACTS: Plaintiff was employed as a motor wheel employee by defendants. He was operating a banding machine which was manufactured by the defendant when the machine allegedly "jumped" and injured his fingers. During the time he was on the payroll, plaintiff suffered 78 Industrial Accidents and was out on disability for 11 years.
Plaintiff alleged the band gave away and it sprained his fourth and fifth fingers resulting in ligament damage or a fracture which necessitated multiple surgeries and that he suffered a fused wrist resulting in permanent disability as a direct result of the accident.
Defendant contended plaintiff could not have injured his wrist in the manner alleged and plaintiff's wrist injury was not proximately related to the accident. Further, plaintiff had had 78 Industrial Accidents during his work life and could only do a one-handed job.
