SUMMARY: A 13-year-old girl sued following a late evening slip-&-fall as grocery store employees were buffing the floors. Delchamps did not show up for the trial.

The girl had pre-existing injuries that did not seem to affect the verdict. 13-year-old Krishelle Scioneaux and her mother, Ann were shopping at 9 in the evening. Workers had started using a scrubber machine on the floors. Krishelle rounded the corner and slipped on water that was left on the floor at the end of the aisle, hurting her wrist. Near the end of the aisle was a lobster tank, where Plts said warning signs for a wet floor were actually placed where they could not see them.

Delchamps did not appear for the trial. The Manager had testified in deposition that the store starts cleaning floors when activity dies down, and cleans them before closing so that employees wont have to be held over late. Plts had stipulated that testimony would be acceptable, but the manager's deposition was never introduced. Delchamps also had not disputed that the store employees had mopped the floor and left water on the floor. Delchamps did claim injuries were pre-existing, but (according to Bateman)did not put up a defense on the liability issue.
