Shows MD, a cardiologist, was eating breakfast at a Shoneys Restaurant. She had made her selections from the buffet and was returning to her seat. She slipped on a spilled liquid that had been improperly mopped. Def. Shoneys Inc. and their insurance carrier stipulated to liability but questioned whether the Slip and Fall were the sole cause of her damages. Dr. Shows had a chronic headache problems and a cervical fusion from automobile accident that pre-dated the slip & fall. The Defendants also argued that much of the decrease in her business was because she chose to work as a solo practitioner, instead of as a member of a firm or hospital. The impact of the injury on her business should have been temporary.
