A Work Accident is defined as “an external, sudden, unexpected, unintended, and violent event, during the execution of work or arising out of it, which causes damage to the health of or loss of the life of the employee (the insured).”
For an accident to be qualified as work-related, there has to be a relationship between the work and the violent event that took place. The employer is only obligated to compensate the victim for a Work Accident if the accident is due to “willful misrepresentation”. Rather then being permitted to sue the employer for the actual damages, injured workers, under US law, are usually compensated in accordance to the type of injury.
